General Terms and Conditions (GTC)

1. Scope

1. These General Terms and Conditions (GTC) apply to all services of Heimtreffer Landolt, owner Steven Landolt, Alte Horgenbachstrasse 11, 8548 Ellikon an der Thur (hereinafter ‘Heimtreffer’).

2. They apply to private individuals and to companies, administrations and other organisations that make a request via Heimtreffer (hereinafter ‘Customer’).

3. By sending a request, the Customer accepts these GTC in the version valid at that time.

2. Services of Heimtreffer

1. Heimtreffer refers customers who are planning a solar installation, battery storage or accessories to suitable solar companies and advises them on comparing the quotes.

2. Advice is given as required by phone, by video, by email or message, or on site at the Customer’s premises. On request, Heimtreffer also discusses the contract of the chosen solar company with the Customer, for example at the signing.

3. Heimtreffer passes a request on to up to three suitable solar companies from its own partner network.

4. If Heimtreffer cannot find a suitable solar company in the partner network, Heimtreffer may pass the request on to another suitable solar company. The Customer will be informed of this.

5. Heimtreffer explains the differences between the quotes, for example in price, components, scope of services and warranties. Heimtreffer does not make a binding recommendation. The Customer decides independently whether and which quote to accept.

6. Heimtreffer does not plan, supply or install systems. Heimtreffer guarantees neither a certain number of quotes, nor a certain price, nor that a contract will be concluded.

3. Costs and referral commission

1. Heimtreffer’s services are free of charge and without obligation for the Customer, including the on-site consultation.

2. If a contract is concluded between the Customer and a solar company, Heimtreffer receives a referral commission from this solar company. The Customer pays Heimtreffer nothing.

3. The solar company sets its own prices. Heimtreffer has no influence on them.

4. Conclusion of a contract with the solar company

1. A contract for planning, supply or installation is concluded exclusively between the Customer and the solar company. Heimtreffer is not a party to the contract and does not act on behalf of the solar company.

2. The terms of the solar company apply to this contract. It is solely responsible for the quote, execution, deadlines, warranty and guarantee.

3. Heimtreffer’s support at the signing of the contract is a form of assistance. It does not replace a legal or technical review.

5. Obligations of the Customer

1. The Customer provides truthful and complete information about themselves and their property.

2. The Customer is the owner of the property or is entitled to obtain quotes for it.

3. The Customer cancels agreed appointments, in particular site visits, in good time if they cannot attend.

4. If the Customer concludes a contract with a referred solar company, they inform Heimtreffer of this on request.

6. Liability

1. Heimtreffer provides its advice carefully and to the best of its knowledge. It is based on the Customer’s information and the quotes of the solar companies.

2. Heimtreffer is not liable for the services of the solar companies, in particular not for planning, execution, defects, delays, yield forecasts or prices.

3. Heimtreffer is not liable for the accuracy of information from the solar companies, for example on yield, profitability or subsidies.

4. Otherwise, Heimtreffer is only liable for damage that Heimtreffer has caused intentionally or through gross negligence, to the extent permitted by law.

7. Feedback and reviews

1. After completion of the project, Heimtreffer may contact the Customer and ask for feedback on the advice and the solar company, for example for a Google review.

2. Feedback is voluntary. The Customer only receives further advertising if they have expressly agreed to it.

8. Data protection and termination

1. Heimtreffer processes personal data in accordance with the privacy policy on the website.

2. The Customer can withdraw their request at any time and end the collaboration with Heimtreffer without giving reasons. A message by email is sufficient. This incurs no costs for them.

3. Heimtreffer may decline a request or end the consultation, in particular in the event of incorrect information or if no suitable solar company is found.

9. Final provisions

1. Heimtreffer may amend these GTC at any time. For a request, the version published on the website at the time of sending applies.

2. If a provision is invalid, the remaining provisions remain valid.

3. Swiss law applies.

4. The place of jurisdiction is Winterthur. Mandatory places of jurisdiction are reserved, in particular for consumers at their place of residence.
